摘　　要： 法律是建构两性关系的重要工具。在人类历史上，法律将男尊女卑的观念和性别等级模式合法化、制度化。法律对性别关系的建构，在传统法律文本中体现尤为明显。本文通过对东西方传统经典法律文本的解读，梳理性别秩序被建构的状况，揭示妇女解放运动的发展过程即是追求法律上两性权利平等的历程，充分认识在现代社会法律对于确立新的性别关系的重要作用。 The law is an important tool to build gender relations. In the history of mankind, the law will be the concept of men being superior to women, and make gender hierarchy model legal and institutional. The legal construction of gender relations in the traditional text of the law is particularly reflected. Based on the classic East - West interpretation of legal texts, carding construction situation of gender order, to reveal the development process of women＇s liberation movement, that is, the right to the pursuit of gender equality in law, and fully aware of the important role of the law in modem society for establishing new gender relationship.
