摘　　要： 职业病是长时间接触有害物质或环境的结果,从"患"病到发病通常有一个较长的时滞过程,治疗和康复过程也相当长,由于职业病潜伏期长、从业工人流动性大以及劳资双方对职业病不了解、不重视、忽视定期检查等原因,且法律法规对此类事故处理没有特别的规范,造成部分已患职业病的工人诊断、治疗延误,索赔失效。我国目前职业病危害以及职业病状况令人担忧,现行职业病保险保障制度中仍存在一些问题亟待解决,对职业病保险保障制度加以完善,维护劳动者合法权益,是当前社会保障工程的一项重要任务。 An occupational disease is the chronic ailment of protracted contacting harmful material or environment. It usually involves considerable time lag from the contracting of disease to its discovery and the processes of treatment and rehabilitation are rather lengthy. Due to reasons such as the long incubation period of such diseases, the high mobility of the workforce, the lack of concern and/or lack of understanding on occupational diseases of both the employer and the employees which lead to the neglect of regular check - up, coupled with the fact that there is no specific rules and regulations to handle such issues in the prevailing laws, resulted in the delayed diag- nosis, deferred treatment and invalid claims. The current threats of occupational diseases and the prevailing status of these diseases in PRC cause worries and concerns. There are some problems exist in the present occupational dis- eases insurance protection system pending to be resolved. To enhance the occupational diseases insurance protection system and to safeguard the legal rights of the labourers are an important task in the current social security project.
