摘　　要： 公用事业民营化的基本理念在于:充分激发个人利益最大化的行为动机,以实现公共利益最大化。在实践中,一些地方的民营化还处于"摸着石头过河"的阶段,常常发生损及公共利益的事件。但是,作为"新公共管理运动的主流",民营化不会因其负面效应而遭到抛弃,它仍将在公共治理中扮演举足轻重的角色,问题的关键在于如何合理地界定政府的角色。深圳市梧桐山隧道事件表明:在公用事业民营化的进程中,当公共利益遭遇私人利益时,政府应当扮演好自己作为监管者的角色,同时也应成为坚守法治精神与商业信用的楷模。 The practices of privatization have produced a lot of good effects. But the basic idea of this governance model also leads to the damage of public interests. Taking the W Mountain Tunnel Incident in S City as a case, this article argues that in the confronting between public interests and private interests, the government should act as a good regulator; furthermore, it should also act as an good example of the keeper of the spirit of rule of law and commercial trust.
