摘　　要： 在制作、复制、出版、贩卖、传播淫秽物品牟利罪中,性欲的刺激性乃是淫秽性的应有之义;而本罪侵犯的是国家对文化市场的管理秩序和公众正常或健康的性观念;贩卖可以包括单纯的出卖;出版既遂应以淫秽物品已制作成印刷品为标志;对于"明知他人用于出版淫秽书刊而提供书号"的情形,主观方面不需要"以牟利为目的"。 The paper talks about producing, reproducing, publishing, selling, or disseminating obscene materials with the purpose of making profits crime, making the conclusions that irritation on sex is the content of obscene, and what the crime attacks is the management of the national order on culture and the normal or healthy sexual attitudes of publics, and trafficking includes pure sales, the standard of publishing being completed is obscene materials becoming the production of printed matter, and in order to profit-making purposes is unnecessary to offender providing the book number in the station of knowing that another person use the book number to publish obscene publications.
