摘　　要： 通过对《合同法》中确立的同时履行抗辩权、后履行抗辩权、先履行抗辩权(不安抗辩权)这三种抗辩权行使的条件、程序、效力的逐一分析,指出三权的异同点,从而使合同当事人在合同履行的过程中能够更好地领悟、把握、正确适用法律所赋予的三种不同情况的抗辩权,以便更好地保护合同当事人的合法权益。 ＂Contract Law＂ establishes to fulfill defense at the same time, fulfill defense latter, fulfill defense first, according to analysis of these three kind of Defenses＇ condition procedure, the potency attention, we can draw similarities and differences between the right to three points, thus enables the contract litigant in the contract fulfillment process to better understand and grasp, Correctly apply these three different defenses in order to better protect the legitimate interests of contract litigant.
