摘　　要： 现代婚姻基于人格独立而赋予夫妻双方平等的法律地位,配偶基于婚姻关系之存在也享有相应的人身、财产权,其合法权利受法律的平等保护。配偶一方不履行法定义务,侵害另一方的合法权益,造成对另一方侵权的,亦应承担相应的民事责任。但我国现行婚姻法和司法解释仅规定了离婚损害赔偿制度,对婚姻关系存续期间的侵权损害赔偿却未涉及,而现阶段婚内侵权行为的大量出现和司法实践的困境更凸显出这方面法律制度的缺失。基于此,本文着重对我国构建婚内损害赔偿制度的可行性进行了分析和探讨。 The modern marriage has been given the content of equal status as a couple based on the idea of personality independence,the Spouses also enjoy various identity rights and property rights,which are protected by the laws. If one side dose not fulfill the legal duty and violate the legal rights and interests of another side of the spouse,he or she will inevitably cause infringement upon the other＇s lawful rights. Unfortunately,the revised Marriage Law and the Judicial Interpretations only provide the divorce com- pensation system,not involved in the tort compensation when the martial relationship continues to exist.But more and more tort eases in the martial relationship calls on the laws perfect. Based on the facts,the passage gives a brief discussion on constructing the martial compensation system.
