摘　　要： 司法审判所依据的案件事实,不仅是证据的产物,更是一个叙事活动的产物,人物形象的塑造是其中关键的叙事策略。叙事者根据预设的人物形象及其价值定位,来运用证据等材料建构故事化的事实文本,并使用人物形象来诱导受众认同叙事者建构的文本以及叙事者所预期的司法结果。同时,司法结果能否得到民众的认可,除了必须符合实体和程序的法律规范,也需要让事实叙事符合民众的经验语境。 The fact of the case that results in judicial decisions is a production of narrative rather than a direct outcome of evidences. The most important narrative strategy in the judicial process is the characterization, which guides the narrator organizing evidences into a story. And images of the characters in the story also induce andiences to recognize the judicial result expected by the narrator.
