摘　　要： 《刑法修正案(七)草案》主要针对破坏社会主义市场经济秩序罪、侵犯公民人身权利民主权利罪和贪污贿赂等犯罪中的新情况,对现行刑法规定的犯罪提出修正建议。其中既有拟增设的组织、领导传销罪等罪名,也有对现行刑法中已规定的一些犯罪在构成要件上和法定刑设置上的修正。从总体上来说,此次草案的内容是较为科学和明确的,但亦存在一些需要思考的问题。 The criminal law draft for amendment （7） puts forward the amending proposals for the present criminal law, mainly aiming at new conditions in crimes of disrupting the order of the socialist market economy,crimes of infringing upon citizens＇ rights and democratic rights and crimes of embezzlement and bribery. There are newly-added crimes such as the crime of forming or leading multi level marketing,and amendments in constitution and the legal punishment of several crimes stipulated in the present criminal law. In general, the contents of this draft are more scientific and clear, but there are some problems to be considered.
