摘　　要： 告知义务是我国保险法中的重要制度之一,当前,我国保险法中关于告知义务的规定还存在一些立法缺陷,主要体现在告知义务的主体、履行时间、履行方式、构成要件的主观标准等方面,完善我国保险法中关于告知义务的规定,必须从这几方面进行探讨。 Duty of disclosure is one of the important systems in China＇s insurance law. At present, there exist certain legislative defects in duty of disclosure in China＇s insurance law. These defects are reflected in the aspects of subject of duty of disclosure, fulfilling time, fulfilling mode and subjective criteria of constitutive elements. This article gives a thorough discussion on these issues in order to perfect the relevant prescriptions in China＇s insurance law.
