摘 要: 从现实社会中广泛存在的且问题频发的"包工头"(即自然人清包人)所引发的一个案例出发,因为法律上缺乏对相关问题的定性并由此造成司法实践中处理模式的莫衷一是.针对司法实践中比较为普遍的把之作为民事案件并从自然人清包人作为雇主的身份来追究其民事赔偿责任这一做法,而笔者从民法和劳动法的角度出发论证了"自然人清包人非雇主"这一结论并对相关案例的处理提出了采用事实劳动关系的说法,从工伤角度出发从而追究相关用人单位的责任,最终达到解决问题并且最大限度地保障劳动者合法权益的目的。 This essay first introduces a case between the head of labor contractor and the labors that commonly and frequently takes place in our society. Since there is lack of laws and regulations dealing with such problems, the results are always different. Aiming at the fact that in the practice of justice which takes the head of the labor contractor as the employer from the angle of civil relationship, the paper objects such practice and concludes that the head of labor contractor is not the employer and such cases should be dealt with in the labor relationship, So in this way, we can solve the problem perfectly and safeguard the labor's rights and interests to the largest extent,
