摘　　要： 侦查程序的改革必须兼顾侦查效率与保障人权，不存在何者优先。对旧制度的批判必须建立在客观事实基础上，构建新的制度的前提是社会有实施该制度的共识。砌筑平衡侦查效率与保障人权的观念及基础是当下的关键。 The reformation of investigatory order should be based on the efficiency of investigation and the guaranty of human rights, neither of the two shouldn＇t be prioritized. The criticism to old system also should be based on the objective facts, and the common understanding of implementation of the new systern is the base of constructing of the new system. The current key is to keep the balance between the investigatory efficiency and the idea and base of guaranteeing human rights.
