摘 要: 善意取得制度是一种以牺牲财产"静"的安全为代价而保护财产"动"的安全的制度架构,集中解决在无权处分情况下的权利瑕疵问题。我国物权法第106条规定的善意取得制度解决了无权处分的权利取得问题,但它将登记作为不动产善意取得的起点,对不动产善意买受人保护不够,构成善意取得在公示方面的缺隐;同时对无权处分人所交付的标的物的质量瑕疵及延迟交付等问题无暇顾及,不足以提供充分的救济调节交易当事人之间的关系。因此,该制度还需要进一步完善。 The Bona Fide Acquisition System focuses on protecting the property's mobile security,at the cost of its stationary security,trying to solve the problems without the Authorized Disposition.The Bona Fide Acquisition System,in Article 106 of the Property Law of China,provides a good solution to these problems.But the law-makers neglect the following problems: register is the starting point to realize the Bona Fide Acquisition System,which obviously can't offer enough protection for the buyers without malicious intention,so it becomes a flaw in showing the system to the public;meanwhile,the system doesn't cope with the flaws in quality and the delay in delivery so that there is not enough relief to alleviate the relation between the two transaction sides.Therefore,there still remains something to discuss.
