摘 要: 结合《物权法》关于车库归属的立法规定,对以约定方式确定住宅小区地下车库、车位归属的合法性与合理性进行了分析,指出应根据小区配套设施有无独立确权的法律基础对其进行分类,区别立法,并具体给出了法定小区配套设施所有权的制度设计,揭示了立法清晰界定小区地下车库等设施归属的制度意义。 Based on The Property Law, the legality and rationality that affirmed property right of garages under ground in residential parts by contract is comprehensively analyzed in the paper. Then the paper brings forward that we should make a distinction about auxiliary facility according to that whether its property right could be independently affirmed by law, and provides concrete institution design to affirm its property right. At last momentous current significance and far-reaching significance of affirming garage property right by law is revealed in the paper.
