摘 要: 我国现有反恐怖立法在预防上缺乏统筹规划与宏观架构,在处置上主体不明、职责权限界定不清。我国应制定统一的反恐法典,对恐怖组织、恐怖行为等基础概念的特定内涵进行界定,明确反恐怖主义的基本原则是法定、综合预防、社会参与、效益、受害人权利保护优先。对正在发生的恐怖行为由法定行动主体实行一长制处置。为有效制止恐怖行为对恐怖分子可作最低让步谈判。对恐怖行为造成的无辜公民损失由国家恢复。 China's current anti-terrorism legislation lacks of planning and macrostructure. In dealing with terrorist activities, the subject of law is not clear and the responsibilities are not clearly defined. China should enact a unified anti-terrorism law to define the terrorist organizations, terrorist activities and the basic principles of antiterrorism such as comprehensive prevention, community involvement, effectiveness and prior protection of the rights of victims. Chief Executive of the statutory body is responsible for the terrorist activities that are taking place. To effectively combat terrorist activities, we can make the minimum concessions to terrorists in negotiations. State bears the loss of innocent citizens caused by terrorist activities.
