摘 要: “定制营销”是现代企业在新的竞争条件下,为占领更多的市场份额而普遍采用的一种营销手段。作为一种新的营销模式,定制营销以其独有的优势在实践中显示出了强大的生命力。但是,如果稍有不慎却又可能落入“专利陷阱”之中,构成专利侵权。针对这种情况,我们对定制营销构成专利侵权的行为进行分析,并在此基础上对如何更好地给予企业相应的法律保护展开探讨。 Customization marketing is a commonly used marketing method by modern enlerprises to get more market share in competition. As one kind of new marketing patterns, customization marketing demonstrates its formidable vitality in practice. However, it may fall in "the patent traps" and cause patent infringement. In order to solve the problem, the authors introduce the patent infringement behavior in customization marketing, and present some suggestions on how to get more legal protection.
