摘　　要： 共同危险行为理论的合理性能体现出法律调控、平衡加害人与受害人利益的高度技巧,准确把握共同危险行为的构成要件理论非常必要。如果从实质内容上理解,应主张主体的复数性、加害人行为的危险性及不可确定性、主观上实际致害人(惹起人)的过失以及主张择一的因果关系说和推定的因果关系说。 The rationality of joint dangerous act theory shows the skills of legal control, beneficial balance between the inflicted and the aggrieved parties, therefore, it is very important to know exactly the elements of joint dangerous act. If learnt according to substance contents, as for the subjective elements and objective elements, this essay prefers to the theories such as plurality of the subject, danger and uncertainty act of the inflicted, subjective fault liability of the aggrieved. As for the causal relationship, the behavior and the damage between the consequences of an optional theory and cause-effect theory are preferred.
