摘　　要： 研究法律依据是建立体育仲裁制度,进行有效立法,提高立法质量的关键。宪法和立法法对体育仲裁立法起着指导作用;仲裁法、民事实体法和民事程序法是体育仲裁立法的直接依据;体育行业规范、国际公约和国际惯例是体育仲裁立法的参照依据;排除了中华人民共和国体育法、行政法规、地方性法规及判例的依据。 Researchlng the legal basis is the key to establish the arbitration system and certify the effectiveness of law in sports area. As for the arbitration of sports issue, the function of constitution and legislation is to be a guidance; the law of arbitration and of international civil procedure are regarded as direct legal basis; and then the norm of sports and international conventions and practice are the reference of arbitration legislation on sports issues. Its aim is to effectively settle the sports issues in China at present.
