摘 要: 要在大型体育赛事中充分开发电视转播权,实质上是要完善的构建赛事转播权的权利内容体系,并在此基础上选择合理的销售模式和策略。而要完善赛事转播权的权利内容体系,必须正确而又合理的界定其法律归属。本文针对目前业界对体育赛事转播权性质的种种界定观点一一进行辨析,最终认为,体育赛事转播权应归为民法中的无形资产中的非知识产权性质,将其直接定性为无形资产,其权利内容体系依据民法的基本原则而构建。这样定性以后,对赛事转播的权利开发可能就变得更加清楚、明晰。 we should consummate the content system of TV relay right if we want to develop adequately TV relay right, and select the logical marketing pattern , But we must definite accurately its legal nature if want to consummate the content system of TV relay right.
