摘 要: 从土地产权的角度看物权法,物权法必定会对城市规划产生深远的影响。首先,城市规划是对土地产权的进一步限定,限定土地产权意味着土地利益的重新分配。正因如此,不确定的城市土地规划会造成土地产权不确定的后果——土地资源流失和环境质量下降。我国南方地区的"大盘"开发事实上是商品房开发市场对规划的开发控制的不信任所致。所谓土地区划的私有化。最后提出,优良的城市质量建立在个体土地利益得到充分保护的基础上,但过分强大的个体土地相关利益也会有害于城市整体利益。发展中市场经济城市在这方面有许多经验教训值得人们注意。 The new law on the property rights will be a significant factor in the reform towards market economy, and it is a landmark in the protection of private properties in Chinese history. Form the perspective of land rights, that law will have a profound impact on land use planning. First of all, land use planning defines land rights. Definition of land rights makes land use planning political in nature. Uncertain zoning will make land rights ambiguous, and ambiguous land rights are responsible for wastage of land resources and deterioration of urban environment. Good cities are based on private land rights free from infringement. However, too strong private land-related interests will hurt the interest of urban community as a whole. There are many lessons we should learn from developing cities in this regard.
