摘 要: 国际刑事法院是世界上第一个常设国际刑事司法机构,其管辖权补充性原则直接影响着缔约国和非缔约国的权利和义务,关乎国际义务与国家主权的均衡协调。《罗马规约》对于管辖权补充性原则进行了多层次的规定和要求,但同时也存在有关非缔约国主权、案件不可受理性和“一罪不二审”的例外与冲突。对于检察官重复启动调查、起诉程序以及修改、追加指控或代之以较严重的指控的权力,应当实施限制次数和间隔时间的制约措施。 The International Criminal Court is the first permanent international criminal judicial institution in the world, and its complementary principle affects both the fights and obligations among the States Parties and Non - States Parties, especially for the equilibrium in harmony between international obligation and national sovereignty. Although the Rome Statue stipulates the general situation about the Complementary Principle of the Jurisdiction in several aspects, it has the interrelated provision about the exceptions and conflicts which concerns the Non - States Parties sovereignty, the inadmissibility and "neb is in idem" of a case. It is necessary to take the restriction of times and intervals so as to control the prosecutor's power to start' the procedure of investigation and prosecution and the power to amend the charges and even add additional charges or to substitute more serioas charges.
