摘　　要： 知识产权权属制度的合理与否,会影响产学研联盟各方潜力的发挥。我国现行法律中相关制度呈现出逐步重视当事人意思自治和构建利益平衡机制两大特点,仍应加以完善,其重点在于更好地兼顾产、学、研、国家等各方的利益以及产学研各方内部工作人员的利益。 The rationality of the intellectual property＇s attribution may affect the potential of the Combination of Production, Learning and Research. Our law now in action shows two characters： firstly, it attends to pay attention to protecting the freedom of people＇s idea; secondly, it emphasizes on construction of balance of different people＇s interests. It still should be improved on the aspects of balancing the interests of the Production, Learning, Research and the state; and that of the workers inside the combination.
