摘　　要： 和谐社会的法律特征可概括为法治、公正、稳定和权威。司法公正在构建和谐社会中的功能定位应当是实现民主法治、促进社会公平正义、维护社会安定有序。建立健全有中国特色的社会主义宪政是实现社会真正和谐以及司法公正的必然选择;司法独立是实现司法公正的体制条件;较高的司法人员综合素质和合理的司法机关内部审判机制是实现司法公正的基础条件。以公正促和谐,既要以先进理念引领司法实践、以程序公正促进社会和谐,更要以实体裁判公正实现社会和谐。 Social harmony is legally characteristic of rule of law, justice, stability and authority. The function of judicial justice in promoting social harmony can be construed as realizing the democratic rule of law, promoting social justice and keeping compatible social order. It＇s inevitable political choice for maintaining social harmony and practicing judicial justice to establish and perfect China-style constitutionalism; judicial independence is the systematical prerequisite to practice judicial justice; superior judiciary overall quality and reasonable court＇s inner case-hearing system is the fundamental condition to practice judicial justice. Factors affecting China＇s judicial justice can mainly be summarized as follows： nihility of court＇s constitutional position, decentralization of judicial power, restriction of traditional case-hearing mode, judiciary＇ s inferior quality, and traditional sense of administration superior to jurisdiction and of efficiency superior to justice. To promoting harmony with justice, we must guide the judicial practice with advanced concept, promote social harmony with procedural justice, above all, realize and keep social harmony with substantive just adjudication.
