摘　　要： 源于民间、流传广泛的谚语与其他文学形式相比,具有更加浓厚和深刻的乡土色彩,因而也更能够反映出传统中国乡民的法律意识与诉讼心态。通过对这类资料的梳理、考察与阐释,我们可以解读出乡民视野中对于帝国法律和帝国衙门的基本态度,以及他们心目中的社会秩序与诉讼境遇。谚语不仅是传统中国乡民的法律意识和诉讼心态的表达,同时还具有指引乡民建构法律秩序,以及表达他们的法律思想和诉讼感受的价值。 In comparison with other literature forms, proverb, which comes from folks and is widespread, has richer and more profound folk colors. Thus it could reflect the legal consciousness and litigation mentalities of traditional Chinese folks. From the investigation and illumination of these materials, one can understand the fundamental attitude of the folks toward the empire law and its executive organs, as well as the social order and the litigant condition in their scope. Proverb is not only the expression of the legal consciousness and litigation mentalities of traditional Chinese folks, but also valuable in the guidance for the folks to construct legal order and in the expression of their legal thinking and litigation feelings.
