摘　　要： 本文在简述学术界关于中国古代道家“法自然”思想是否为西方“自然法”学说的讨论的基础上,分别论析了道家“法自然”思想以及西方“自然法”学说的意蕴,并对其两者进行比较,指出两者在对待法律的态度、思考天人关系的模式以及文化要义诸方面的不同,进而论证了道家“法自然”思想非西方“自然法”观念。 Begin with a discussion on whether the theory of the Western natural law is originated from the Taoist＇s thought of emulating nature in ancient China in the academic field, the paper analyzes their meanings and makes some comparison between them. Then it is pointed out that there are some differences in attitude towards law, thinking modes on relationship between nature and man, their own culture. It is concluded that the Taoist＇s thought of emulating nature in ancient China and the theory of the Western natural law are not the same one in nature.
