摘　　要： 地方政府的法理基础是宪法和法律对地方政府的界定。建国之后,我国地方政府的法理基础经历了1949—1954年的初步建立时期、1954—1978年的波动时期和改革开放以来的继续发展时期,建立起了基本框架,但仍存在盲区,即未能对一般地方政府与中央政府的职权做出具体的划分。解决出路在于从宪政结构出发,划分地方专有权力,形成与中央的权力制衡。 The law foundation of local government is the definition of the constitution and the law to the local government. Since the founding of our nation, the local govemment＇s law foundation has experienced preliminary establishment time from1949 to1954, undulation time from 1954 to 1978and the time to continue development after the reform and open policy. The basic frame has been established, but it still has the blind spot, namely having not made the concrete division to the power of the general local government and the central authorities. The solution is to divide the place appropriation power on the base of constitutional government stracture, to make balances with the power of central authority.
