摘　　要： 当前我国有关商业贿赂行为的法律法规体系尚不够健全,商业贿赂通常得不到应有的查处,从而发展成为部分行业的市场“潜规则”,这必将损害我国社会主义市场经济体制的正常运行,造成国有资产大量流失,损害广大消费者的合法权益。要更好地防治商业腐败,维护我国公平竞争的市场环境和投资环境,必须加强立法,从源头上加以治理。 The legal system and regulation are not perfected about the commercial bribe practice It is not real investigated and dealt with the commercial bribe in business operation Circulation. It is, therefore, the business bribe becomes the usual potential practice in some business trade in the market economy. This bribe would make harmful to the normal operation of our country＇ market economy which makes great loss of our stat-owned assets and spoils the consumers right and benefit. In order to prevent and cure the business bribe, to safeguard the fair competition and to protect the environment of the market and the capital investment it is the key point to legislate to control it from the essential source.
