摘　　要： 赤道原则是由世界主要金融机构根据国际金融公司的政策和指南建立的、旨在管理与发展与项目融资有关的社会和环境问题的一套自愿性指南,现已发展成为国际银行业公认的国际惯例,不过,它作为惯例的生成特点与众不同。它的出现,将会使国际贷款协议的条款增加或做一些必要的修改,贷款人也可能会因此承担法律责任。赤道原则对我国的环境与社会法律的立法结构、程序法和实体法都有参考价值。 The Equator Principles are a set of voluntary s guidelines aiming at managing and developing environmental and social problems related to the project finance, drafted by the world primary finance institutions on the basis of the International Finance Corporation＇ policies and guidelines, which now become a industry customs. They will make the provisions of the loan document added or modified, and the lenders with the legal liabilities, which also can give some reference to the China＇ environmental and social laws.
