摘　　要： 恐怖组织的形式化界定虽有利于司法操作,但有凭借强权暗箱操作之嫌,也不利于对新兴的恐怖组织的惩治与防范;恐怖组织形式与实质相结合的概念仅仅弥补了纯粹形式化概念的部分缺陷;恐怖组织的定义中应有规模下限的要求;不能把恐怖犯罪之动机以及最终目的作为定义的要素;应该注意恐怖组织意图实施犯罪的长期性。总之,所谓恐怖组织,是指三人以上以长期实施一种或多种恐怖犯罪活动为目的的犯罪组织。 Although formalized definition of the terroristic organization is propitious to judicial operation, suspicion of wirepulling by the might still exists and this method of definition will make against punishment and prevention of burgeoning terroristic organization. The definition combining the form with substance of the terroristic organization may only remedy part limitation of pure formalized conception. The definition should contain the lower limit of the size, the motivation and ultimate purpose should not be definitive elements, and long- term intention of crimes of the terroristic organization should he noticed. In conclusion, terroristic organization indicates a criminal organization organized by at least three persons for the purpose of implementing multiple kinds of terroristic crimes for a long term.
