摘　　要： 在船舶经营管理实务方面,存在船舶经营人和船舶管理人两个相似的概念,由于目前我国法律对此没有做出界定,司法实践中对二者的权利义务以及民事法律责任的认定也没有统一的标准,使得这方面的纠纷难以得到解决。为了规范航运市场主体行为,文中试图从几个方面详细区分船舶经营人和船舶管理人,藉此理清二者的关系和责任的认定。 There are two similar parties, that is, ship operator and ship manager, in ship operation and management. however, the law in our country does not define them at all, there is no general standard to determine their rights, obligations and civil liability. Therefore it is difficult to solve the problems arising from them. In order to regulate the behavior of shipping parties, this paper tries to distinguish ship operator and ship manager in details inorder to help making a clear concept between them.
