摘　　要： 由于夫妻约定财产制体现为夫妻双方通过协商确立夫妻双方相关财产权的归属。因此,这种财产制度的理论应以契约理论为基础。同时,这种财产制度又是以婚姻关系为前提的。这就决定了夫妻双方对财产的约定具有不同一般契约理论的特殊性,具体表现为:订立契约的主体具有不可替代性;这种契约同时对夫妻以外的第三人产生约束力;夫妻任何一方因违反契约要承担特定的民事责任,并可通过婚内赔偿请求权或期待权获得救济。 The Conjugal Contractual Property System means that wife and husband estabish the ownership of relevant property right by negotiation.Therefore,it should be based on the couple＇s property contract,different from the ordinary contract, which specifically lies in： The subject who signs the contract is irreplacable; The contract is a bind to the third person besides the wife and husband;If violating the contract,the wife and husband must bear special civil liabilities and can obtain relief by request right or expectation right inside marriage.
