摘　　要： 改革开放以来,我国立法者对法律的功能经历了从专政工具到治国方略的转变过程,在立法理念关于法律的稳定性和法律的“粗”、“细”等方面都有了新的认识。社会转型时期的立法如何在维护法的稳定性和适应社会现实的变动之间谋求平衡是时代对立法提出的新的挑战。 Our country is in the period that the society is making the transition sharply. Under this background, the legislators＇ legislative idea has changed deeply too. Choosing the communiques of Standing Committee of the National People＇ s Congress from 1980 to 2004 as the research object, this article discussed the changes of the legislative idea in the 20 years and some questions that is worth introspecting.
