摘　　要： 司法理念是法官制度构建的基础,法官制度在设计中应该有系统成熟的理念作为指导,而司法理念的明显滞后已成为制约法治发展的“瓶颈”。为了适应现代司法理念要求,我们必须完善法官制度的建设。 Judicial idea judge foundation that system structure, judge system should have system ripe idea as guidance in design, the obvious lagging of and the judicial idea has already become “ bottleneck ” which has restricted development governed by law. Judicial neutrality , judicial independence , justice form the basic content of the modem judicial idea . Traditional judge＇ s system has some following obvious drawbacks ： First, the judge has complicated source, overall quality is on the low side; Second, the administration of judge＇s management; Third, the judge lacks independence . In order to overcome the above drawback , meet the needs of modem judicial idea , we must improve a judge and select to take the post as the system; Define the judge＇ s job range; Standardize the judge＇ s power ; Guarantee the judge＇ s occupational status; Improve judge＇ s responsibility system.
