摘　　要： 文章通过对两大法系和罗马法涉及“诈欺”制度的分析,辨析“诈欺”和“欺诈”用词的优劣,企图以此展示法律语言的“通俗化运动”和法律语言本身特质之间的关系。文章认为在立法文本及译著中使用“诈欺”是妥当的,并且主张法律语言的“通俗化运动”应该有恰当的界限。 This paper focuses on fraud and deceit in Anglo-American and Romano-Germanic legal systems. The paper compares two Chinese words Zhaqi and Qizha,with a conclusion that using Zhaqi as the equivalent of fraud is appropriate. After considering the features of legal language, the paper demonstrates that a limitation on the popularization of legal language is necessary.
