摘　　要： 大学生的权利未能从应然转为实然是因为合理的权利主张未被主流价值观所认同、人们对受教育权的内涵及大学自治的规律认识不透彻以及高校在硬件建设和办学的机制方面跟不上时代发展的步伐三方面的原因。当前大学生们依法维权的阻力不仅仅是规章越位和程序缺失,更深层更难突破的还是办学主体的思想观念和作风。应然的大学生权利转向实然的大学生权利还有不少阻力和障碍,需要各相关主体的共同努力。 An idealistic approach to the college students' right is not realistic for three reasons. First, their just claims of right are not consistent with the mainstream of the social values. Second, the concept of having access to education and the law of universities' self-control have not been realized thoroughly. Third, the hardware construction can not keep pace with the times, neither can the schooling mechanism. At present, the obstacles to protecting the college students' legal rights are not only related to the abuse of regulations or the lack of normal procedures, but also, in a more profound sense, to the university leaders' conceptions and their style of work. To combat such obstables needs concerted efforts in the university.
