摘　　要： 本文从学理和法理两个方面讨论了我国外汇储备注资国有商业银行问题。我们发现,在学理上,本次注资在必要性上还存在一些疑问,此次注资仅仅是可能合理的;在法理上,注资行为存在违规嫌疑。这次注资行为的深远影响还在于:它对我国的改革理念是一次巨大的冲击。 The paper explores the reasonability and legality of injection of 45 billion USD foreign-exchange reserve into Chinese state-owned commercial banks. We argue that the injection is only possible to be reasonable, while it may violate relative regulations. What is more, it may imply a dramatic shock to the reformation ideology. Suggestions are made to prevent from potential problems.
