摘　　要： 民间文学艺术的法律保护问题是20世纪60年代以来就开始讨论的一个复杂问题,至今各国对其态度不一,在我国相关的法律还不存在,实践中也出现了许多纠纷,本文拟从民间文学艺术的概念入手,分析对民间文学艺术保护的必要性、保护程度、保护模式,并探讨了在中国的现状。 The legal protection of folklore has aroused heated debate since the 1960s'. However, there is sill a big controversy over this complicated issue. In China no laws and regulations have been on acted, which leads to many thorny disputes. This essay begins with the concept of folklore, and then has deep insight into the necessity to protect folklore, the extent of protection and the style of protection. At last, this essay points out the imperative to protect folklore in China.
