摘　　要： 行政自由裁量权是现代行政权力的重要组成部分。如果没有自由裁量权的存在,现代行政就失去了其价值和意义。然而自由裁量权因其“自由”的属性又使它极易被滥用,从而出现错位。为了保证行政自由裁量权的合理运作,建议从完善立法、健全司法监督制度、提高公务员的素质和公民的法律意识等几个方面加强对自由裁量权的法律控制。 Administrative fdiscretion right is the indispensable composition part of modern administrative power.If there isn't right,modern administration will lose its value and meaning.However the right flexibility caused by it's makes it be abused very easily.In order to guarantee its reasonable running,we should supervise system and perfect legislative,sound administration of justice such as the quality of civil servants and the legal consciousness of citizens.
