摘 要: 美国、澳大利亚的国家公园和香港郊野公园的行政管理体系,都基本上包含立法、决策、执行 3个层次,并且各层次相互之间关系清晰、权责明确,确保了资源保护的有效性和游憩利用的合理性。结合我国风景名胜区的管理现状分析,可以认为,在行政管理体系中缺乏对立法、决策、执行 3个层次的不同功能和机构划分的考虑,导致了目前的管理权空洞化、管理空间重叠、局部管理垄断等问题。 In the administrative management systems of the national parks in the United States and Australia, the natural parks in Japan, and the country parks in Hong Kong, there're three administrative levels: the legislation, the policy-making, and the operation. Each level can be distinguished clearly from one another, and the relative administrative section knows its own duty and right exactly. Such administrative structure assures the efficiency of resource management and the rationality of recreation activities. As to the administrative management system of scenic areas in China's Mainland, there is obvious lack of consideration on the differentiation of legislation, policy-making, and operation. Thus, problems, such as the inanition of actual power, the overlap of administrative spaces, and the monopolization of partial affair, appear frequently and do harm to the sustainable use of the scenic resources.
