摘　　要： 刑法的谦抑精神指以罪之谦抑与刑之谦抑为内涵的刑法理念。罪与罚本恶,刑法的根据使之合法化并成为刑法正当之善,但同时也注定其张力之限度。不同学派对刑法根据的论证各有千秋,对刑法谦抑精神也有不同认识。中国古代法律制度的价值取向多与谦抑背离,但仍能从相关传统法理念中找到刑法谦抑精神。完善中国刑法的价值理念,破除对刑法的迷信,刑法的谦抑精神不可或缺。 The tolerant spirit of criminal law refers to the criminal theory with intensions of tolerant crime and tolerant punishment. Crime and punishment are evil in essence, but the ground of criminal law legalizes and justifies them, and also limits the tension. Criminologists of different schools have their own views on this spirit for their different argumentation on the ground of criminal law. Although the value of Chinese archaic legal system is disobedient to this spirit, we may find some of that in the traditional ideas. On all accounts, this spirit is important to resist the fetish of criminal law and to consummate the value of that.
