摘　　要： 数据电文作为一项证据 ,必须能被法院认可为具有证明案件事实的证据力 ,一项数据电文是否具有充分证据力 ,应从其客观性、相关性、合法性三个方面去考察。我国数据电文证据立法需要解决的问题是将数据电文作为书证 ,还是作为视听资料。 In this article the author first investigates the problems arising from the employment of evidential rules of Two Legal Systems in data message, then probes into the acceptability and evidentiary weight of data message in evidence by analyzing the related rules in domestic laws, international regulations and interchange agreements on E-commerce, and finally makes a study on the problems of data message evidence in Chinese evidential law and its solutions.
