摘　　要： 医疗纠纷是一种特殊的民事合同关系 ,要正确认识医学和法律两种不同领域的证明关系 ,准确适用民事诉讼规则。在诉讼中 ,既要全面保护患者的合法权益 ,也要考虑医学的高风险特征 。 The medical treatment dispute is a kind of special civil contract concern.We should tell the difference between the medicine and law, applying accurately the rules of civil procedure. In the litigation,on one hand,the lawful rights and interests of patients are fully protected and on the other hand the characteristics of high risks in medicine should be also considered,in order to avoid discouraging the enthusiasm of medical staff.
