摘　　要： “默示协议管辖”的适用范围、效力特征等与协议管辖均有实质性不同 ,故所谓的“默示协议管辖”并不属于协议管辖 ;同时 ,分析了国际民事诉讼中的协议管辖的准据法的两个基本特点 ,认为该准据法并不当然地就是法院地法 ,而且必要时应当对其予以分割。 So-called 'implied agreement's jurisdiction' is not subject to jurisdiction by accord as the result of their substantive difference in applicable scope, validity characteristic and so on. Two basic characteristics of the law applicable to jurisdiction by accord in international civil litigation are analyzed. Applicable law is not always lex fori, and sometimes depecage of the applicable law is necessary.
