摘　　要： 美国新经济产生于全球经济一体化和迅速发展的信息技术的推动。三元结构,是指构成法律所具有的一系列的价值、原则和规则三元素的总和。全球化、异化性和创造性是新经济的内在特性,也是其迅速发展的活力所在,三特性相互依存、缺一不可。新经济的三特性对美国反垄断法及其司法实践提出了严峻挑战。受新经济决定的反垄断法的三元结构只有高度协调一致,才能有效地规制垄断、保护竞争,促进社会的进步和发展。 The new economy has emerged with the global economic integral and the quick development of the information technique in the United States. The three essential factors of the Antitrust Law of America include value, principle and rule. The new economy affected the Antitrust Law of America and judicatory practice from. Cre-ationality, alienation and globalization are the new economic characteristics and where it' s vigor lie. The three essential factors shoud have high consistence, so the Antitrust Law of America can confine monopoly and protect competition and promote society advancing and developing.
