摘　　要： 清末沈家本法律改革承前启后,开中国法制现代化之先河,对后世影响至为深远。然而, 在中国固有政治、文化及社会经济结构尚未发生根本性变化,中国社会尚不具备接纳异质文明的土壤的情 况下,这场超前的法律移植运动一开始就陷入了误区,与生俱来的局限使中国法制的现代化不可避免地流 于表面和形式。清末修律的历史诏告人们,任何一场深刻而有效的变革,必须建立在社会政治、经济、文 化条件充分成熟的基础之上,必须借助波及全社会的启蒙运动作支撑。 The reform of law by Shen Jiaben at the end of the Qing Dynasty carried forward a course and forged ahead into the future.It opened the modernization of law in China, and influences the later ages.The history of the reform of law at the end of the Qing Dynasty tells us that, each deep and effective reform should be based on the conditions that the social politics,economics and culture are fully developed, and the help of those movements has spread all over the society.
