摘　　要： 工资是工人维护其本人和家属生活的重要甚至唯一来源,对工资债权的优先保护体现了国家对人之生存权的尊重。但工资债权与有担保物权的债权竞合时,出于维护交易安全的考虑,工资债权应当劣后于已经进行公示的担保物权受偿。从我国国情出发,工资债权与其他一般优先权之间的受偿顺位,应当根据主体对风险的预测和承受能力的差异为标准进行安排。 Wage being an important or even the sole income source for an employee and his family, the priority protection given to wage creditor's rights shows a nation's respect to its people's right of existence. But when the wage creditor's right and the secured creditor's right overlap,the secured creditor's right of public summons should be given first consideration. As for the internal order between the wage credit and other privileges, we should arrange it according to the different ability to predict and bear the risk.
