摘　　要： 敦煌文书中有一类汉文离婚契约, 年代上属唐代中期至北宋初期, 可统称作“放妻书”。本文对此试作研究, 从基本格式、时代与内容几方面分析, 讨论了与此时期有关的婚姻法和离婚问题, 并就财产关系方面与尼雅和穆格山等地出土的相关文书略做比较, 以说明其间之异同。 In Dunhuangs documents, there is a kind of contracts of divorce written in Chinese, which can be categorized as “Fangqi Shu” (“Certificate of Divorcing Wives”) from the mid Tang dynasty to the early Song dynasty. This paper attempts to analyze this type of document in the perspectives of its basic form, times and contexts, discussing the regulations for divorce practice during the period from mid Tang to early Song dynasties in Dunhuang, a local society in northwest of China. Furthermore, it makes a comparative study from the angle of property relationship between Dunhuangs eastern and western worlds to explain the similarities and differences.
