摘　　要： 滥用职权罪、玩忽职守罪主体对职务违反的心理态度 ,前者为直接故意 ,后者为疏忽大意的过失。对行为的罪过心理仅是一种量刑情节 ,不同于犯罪罪过 ,两罪主体对“重大损失”的发生 ,都为过失心理 ,因此 。 The subjects of crime of abusing the office and crime of derelicition violate their obligation,the former's mentality is direct intent,the latter’is careless negligence.The offense mentality on the act is only a kind of sentencing circumstances,which does't differfrom criminal culpability.Their mentalities about the heavy loss are both mind of negligent offense,so they are negligent crimes.
