摘　　要： 成文法以填充的方式实现对法制的完善 ,判例法以生长的方式实现对法律的完善 ,这两种方式都各有优缺点。实践中 ,西方两大法系采取将成文法与判例法有机混合的方式来实现对法制完善。由于起主导作用的法律传统的影响 ,成文法和判例法在两大法系国家法制完善的具体过程中所起的作用与地位是有所不同的。 To perfect legal system,statute law fills the blanks of law with codes,regulations,principles and legal concepts,while case law depending on the growth of the precedent.Having realized the limitation of the single method,civil law countries and Anglo American law countries combine the two methods organically.It is necessary to point that in the context of the dominant legal tradition,the function and status of statute law and case law are different in practice in civil law countries and Anglo American countries.The conclusion is that the organic combination of the two methods can make the legal system more perfect effectively.
