摘　　要： 我国侦查阶段超期羁押问题相当严重。其形成原因有多种,其中羁押期限制度本身的不合理是一个不可忽视的因素。文章反思了我国《刑事诉讼法》相关立法规则的合理性,并运用比较法就相关的立法提出修改建议。 In china, prolonged detention has become a serious problem. It can be attributed to many factors, which include the irrationality of detention regulations themselves. This paper reviews the rationality of 'Criminal Procedure Laws' and makes suggestions on amendment to the relevant regulations by means of comparison.
