摘 要: 转租与租赁转让、租赁权让与应加以区分。我国《合同法》上的转租有同意转租和擅自转租之分。在这两种情形下,出租人、承租人、次承租人相互间的法律关系如何,理论上均应阐明。擅自转租对出租人的所有权构成侵害,但承租人收取的租金不构成不当得利。 Sublet, transfer of lease and transfer of leasehold should be distinguished. The Contract Law of China distinguishes sublet as approved and unapproved sublet. We should clarify the legal relations among lessor, lessee and sub-lessee in terms of theory in the two cases. Unapproved sublet makes up infringement of title of lessor, but the rents collected by lessee don,t make up illegal profit.
